About the Documentary Clearing House & Associates, LLC:

Documentary Clearinghouse LLC. was organized by two professionals, Barry Wilhelm and Richard F. Kessler, to redress the institutional defects and deficiencies surrounding the collapse of the secondary mortgage market. Barry Wilhelm acts as webmaster with a background in programming, site security, e-commerce, marketing, and design. Richard Kessler is a graduate of Yale Law School and a Washington, D.C. attorney. He has made a career of innovative and first-time legal strategies. What started as a crisis has been overtaken by institutional inertia. Neither public officials nor private enterprise engaged in financing mortgages have shown any inclination to mitigate the losses or take any financial responsibility. The federal government and the financial institutions which precipitated the secondary market collapse have so far successfully resisted regulatory reforms necessary to prevent a reoccurrence of the crisis.

In response, DCH was created to focus attention upon the problems and undertake useful initiatives and programs to help correct the deficiencies and defects in the system. DCH is specifically committed to the following objectives:

In its first project, DCH sponsored a lawsuit against Chief Judge Lee E. Hayworth and two other judges of the 12th Circuit District court of Florida to enjoin the use of the “rocket docket” to violate the due process rights of defendants who did not contest the foreclosure proceedings. The complaint alleges that the judges regularly and knowingly rely upon deficient and defective documents in reaching an uncontested summary judgment of foreclosure. The 12th Circuit admits that it lacks the funds to discipline counsel and read pleadings and supporting documentation so judgment is rendered in reliance upon unread documentation. The case is currently pending before the U.S. District Court for the Middle District of Florida.DCH offered to review documents for the Court without charge to the Court or taxpayers but the offer was rejected.
